Libertaria Sovereign License — Version 1.1

Identifier: LicenseRef-Libertaria-Sovereign-1.1

1. Definitions and scope

You means the individual or legal entity exercising rights under this License. A legal entity includes entities it controls, is controlled by, or is under common control with, where control means ownership of more than half the voting rights or the power to direct management.

Contributor means a copyright holder that intentionally makes an identified contribution available under this License. No person grants rights held solely by someone else. An unsolicited submission does not create a grant by another person’s employer or other rightsholder.

Covered Material means identified original material offered under this License, plus its Modifications. Separately identified third-party material is not converted to this License merely by inclusion in a repository.

Modifications means changes to a file containing Covered Material and new files containing copyrightable portions of Covered Material. Moving, splitting, renaming, translating or generating a file from covered source does not remove the covered portions from this definition. Mere use of an interface, an idea or an unprotectable fact does not make independent code Covered Material.

Source Form means the form preferred for modifying the material. Executable Form means any other form. Larger Work means a combination of Covered Material with independently authored material in separate files.

Distribute means provide a copy to another individual or legal entity. Transfers within You are not Distribution. A contractor acting solely on Your behalf under Your direction and confidentiality duties may receive private copies for that work; it has no independent distribution permission from that private transfer. Operating software over a network without providing a copy is not Distribution under this License.

2. Rights granted

Each Contributor grants You a worldwide, non-exclusive, royalty-free license for the duration of applicable rights to use, reproduce, modify, translate, prepare adaptations of, publicly display, publicly perform and Distribute its Covered Material, subject to this License. You may charge for copies, support, hosting or warranties. Private modification is permitted. No license fee, registration or approval is required.

Each recipient receives these permissions directly from the Contributors. You may not replace the recipient’s rights in Source Form with weaker terms. Ownership is not transferred. No trademark, service mark or endorsement rights are granted beyond the reproduction of required notices.

2.2 Patents

Each Contributor grants You a worldwide, non-exclusive, royalty-free patent license to make, have made, use, offer for sale, sell, import and otherwise transfer its contribution, alone and as incorporated into the Covered Material to which it contributed. Only claims the Contributor can license and that are necessarily infringed by that contribution alone or by that combination are included. Claims infringed only by Your further modifications or other combinations are not included. There is no grant of third-party patents and no warranty of freedom to operate.

If You initiate a claim, including a counterclaim or cross-claim, alleging that this Covered Material infringes a patent, Your patent permissions under this License for that Covered Material terminate when that claim is filed. This provision does not terminate copyright permissions or reach a patent claim concerning unrelated material. Withdrawal of the claim does not itself reinstate patent rights; the affected grantor may reinstate them in writing. Mandatory rights and defenses remain unaffected.

3. Distribution duties

3.1 Source distribution

Distribute Covered Material in Source Form under this exact License. Retain its copyright, license, patent and attribution notices, except notices that no longer pertain to any included material. Clearly identify modified files as modified, with the identity of the modifying party and a date or version reference. No individual programmer’s private address is required.

3.2 Executable distribution

When You Distribute Covered Material in Executable Form, provide recipients with the matching Source Form of all included Covered Material, not only Your changes. Include the build scripts and configuration templates needed to rebuild that covered component. Do not require disclosure of independent Larger Work source or generally available, unmodified build tools.

Make that source available without an additional license charge, either with the executable or through an identified download location. A physical copy may be charged at reasonable delivery cost. An online location must remain available while You distribute that version and for three years after Your last Distribution of it. If a location changes, maintain a usable forwarding notice or otherwise provide affected recipients the replacement location. A complete source copy delivered with the executable satisfies the duty without an ongoing hosting requirement.

Executable terms may differ but must not restrict recipients’ permissions in Covered Material under this License. Include this License and instructions for obtaining source in the accompanying legal notices or documentation. You remain responsible when relying on someone else’s source host.

3.3 Independent components

Independent files of a Larger Work may use any lawful license, including proprietary terms. Copying covered code into a new file does not make it independent. Files containing both covered and independent contributions remain subject to the Source Form duties for that file. Linking through a separate interface, without copying covered implementation into independent files, does not by itself extend these duties to those independent files.

Network use alone does not create a source offer duty. This License does not promise network-service reciprocity.

3.4 Separate rights and material

Preserve separately licensed dependency notices and satisfy their terms. This License cannot override an incompatible third-party license. Data, user content, personal records and credentials are not Covered Material merely because the software processes them. Replace secrets in required build configuration with usable parameter descriptions or safe templates. An exclusion for data or secrets does not excuse withholding covered code.

4. Compliance, termination and reinstatement

Permissions are conditional on compliance and terminate for the relevant Covered Material when You materially breach this License. Termination does not require a registry decision. A Contributor enforcing its rights must identify its rights and the alleged breach; this text changes no statutory burden of proof or court power.

If You cease the breach, rights from a Contributor are reinstated provisionally unless and until that Contributor explicitly and finally terminates them in writing. Reinstatement becomes permanent if the Contributor does not notify You of the breach within 60 days after cessation. If this is Your first written notice of a breach of this License from that Contributor, curing it within 30 days after receipt also permanently reinstates those rights. Patent termination under Section 2.2 has its own rule and is not cured here.

A notice must describe the relevant material and conduct and be sent to a contact address You have designated for licensing, or otherwise be actually received. An electronic notice may be retained in a reproducible form. Reinstatement does not waive remedies for an earlier infringement.

Compliant downstream recipients retain direct grants already received. A Contributor cannot revoke those grants merely because an upstream Distributor breached this License. Expiry, sale or abandonment of a project does not by itself end existing compliant grants.

5. Warranty and liability

To the extent permitted by applicable law, Covered Material is supplied as is without express or implied warranties of merchantability, fitness, title, accuracy, security, or non-infringement. Each recipient evaluates its suitability. No Contributor is liable, to that extent, for direct or indirect loss, lost profit, lost data or business interruption arising from it under contract, tort or another theory, even if advised of the possibility.

No exclusion applies to liability that cannot lawfully be excluded, including intentional misconduct or deliberate recklessness of the liable party to the extent applicable. Mandatory consumer rights remain intact. Anyone offering support, warranty, indemnity or other obligations does so only for itself and must identify that fact; it cannot bind a Contributor without that Contributor’s agreement.

6. Law, interpretation and versions

Dutch law governs this License, without prejudice to mandatory applicable law, including non-waivable consumer protections. To the extent that a valid forum agreement can be made for the dispute, the competent courts in Amsterdam, the Netherlands have exclusive jurisdiction. Mandatory jurisdiction rules remain controlling. Interim relief may be sought in another competent court where applicable procedural law permits it.

No term excludes statutory permissions, including mandatory rights to study, test, make backup copies or decompile software. Invalid provisions are severable only to the extent the remaining arrangement can lawfully stand; no replacement may expand the license scope or waive mandatory rights by fiction. Failure to enforce once is not a general waiver.

Only an express rightsholder notice can offer a different or later version for its material. No automatic later-version election exists. Version 1.1 does not retroactively replace earlier grants or acquire rights in prior third-party contributions. Summaries and registry policies cannot amend it. An agreed translation may assist readers; this English text is the operative license unless the relevant grantor expressly adopts another text.
